These Referral Program Terms and Conditions (“Terms”) are entered into by and between Modern Renewables a/k/a Bromley Community Solar LLC (“Company”) and the individual participating in the referral program (“Referrer”). By participating in the Company’s referral program, the Referrer agrees to comply with these Terms. 

1. Eligibility:
a. The Referrer must be an existing customer of the Company to participate in the referral program.
b. The referred individual (the “Referee”) must be a new customer who has not previously enrolled with the Company.

2. Referral Process:
The Referrer may refer the Company to the Referee by sharing a unique referral code provided by the Company. The unique referral code must be provided as the promo code during enrollment.

3. Rewards:
a. The Referrer may be eligible for a referral incentive following the completion of a successful referral, whereby the Referee must become a validated enrollment by meeting the following requirements:

• Meet the minimum usage requirement of 1,000 kWh/year and provide a valid PSE&G account number.
• Reside in the eligible geographic area.
• Meet any necessary FICO requirements.
• Provide debit or credit card payment information during enrollment.

b. The referral incentive will be issued to the Referrer and, when applicable, the Referee within 4-6 weeks after the Referee completes 1-2 billing cycles and the account balances of both the Referrer and the Referee are paid in full.

4. Compliance:
a. The Referrer is responsible for complying with all applicable laws and regulations while participating in the referral program.
b. The Referrer may not engage in any form of spam or other unethical marketing practices when referring the Company to potential Referees.

5. Expiration and Modification:
The Company reserves the right to modify, suspend, or terminate the referral program at any time without prior notice. The Company may also update these Terms at its discretion.

6. Limitations:
The Company reserves the right to disqualify Referrers or Referees if it is determined that the referral program is being abused or used in an unauthorized or fraudulent manner.

7. Data Privacy:
The Company will collect and process personal information as described in its Privacy Policy. By participating in the referral program, the Referrer and Referee consent to the Company’s data collection and processing practices.

8. Dispute Resolution:
Any disputes or concerns related to the referral program will be resolved by the Company’s sole discretion.
